On October 10, 2008, the Honorable Linda B. Quinn conducted a hearing on a Petition for Writ of Mandate filed in San Diego Superior Court by Preserve Wild Santee, Center for Biological Diversity and Endangered Habitats League, Inc. challenging the EIR for the Fanita Ranch development certified by the City of Santee on December 5, 2007. After oral argument, the court upheld the EIR on all issues other than on the issues related to the EIR's conclusions regarding fire safety. This finding by the court was based upon the City's decision to decline to adopt the use of controlled burning and grazing of Project open space areas. The court, after further oral argument on January 30, 2009, issued a Limited Writ of Mandate directing the City of Santee to reconsider its determination that fire safety impacts are less than significant in the absence of controlled burns and grazing. The court further directed the City of Santee to take all relevant actions necessary to comply with CEQA related to this issue. In compliance with CEQA and the court's direction, the City of Santee has prepared a Revised Environmental Impact Report (""REIR"") regarding the fire safety impacts, with a particular focus on the open space preserve areas of the Fanita Project.
