However, the Final EIR was challenged in court and, on Jan. 4, 2013, the Court issued a writ of mandate directing the 22nd DAA to set aside and vacate certification of the Final EIR and its approval of the project. The Court directed the 22nd DAA to undertake new environmental review regarding: 1. Traffic generation and mitigation. 2. Lack of water supply physical baseline. 3. Lack of greenhouse gas emissions baseline. The court's order provides that the new material will supersede the sections of the EIR found to be inadequate and the 22nd DAA will circulate the new material and the original Final EIR and indicate what sections have been superseded (see the Prologue for these sections). The Court's writ of mandate requires the 22nd DAA to undertake new environmental review consistent with the Court's statement of decision.
