EBMUD executed a contract with the USBR for delivery of a supplemental water supply from the Folsom South Canal unit of USBR's Central Valley Project (CVP). On June 28, 2001, EBMUD certified an EIR for, and approved execution of, an Amendatory Contract with USBR which provides for additional points of delivery of the district's CVP supply, including Freeport on the Sacramento River. On April 15, 2004, the Freeport Regional Water Authority (FRWA), acting as lead agency, certified an EIR for, and approved construction and operation of, the Freeport Regional Water Project (FRWP) consisting of an intake structure and related pumping and pipeline facilities for delivery of EBMUD's CVP supplemental water supply, and for delivery of surface water to Sacramento County Water Agency. On April 27, 2004, acting as a responsible agency under CEQA, EBMUD approved components of the FRWP to be constructed and operated by EBMUD, including pipeline, pumping plant and treatment plant facilities in Sacramento and San Joaquin Counties.
