Document Description
LAFCO fees were last adopted in 1986 and are therefore out-of-date with respect to cost recovery for processing applications and other LAFCO work. Government Code §56383 specifies that 1) the Commission may establish a schedule of fees and service charges, 2) the fees shall not exceed the cost of providing the service, 3) the Commission may require that an applicant make a deposit against the fees, 4) the Commission may waive or reduce fees if it finds payment would be detrimental to the public interest, and 5) time limits for Commission action may be deferred until fees are paid. LAFCO services are directed and performed by Mono County employees, and therefore the proposed LAFCO fees are the same as the 2014-2015 fees adopted by Mono County for processing development applications and proceedings. These fees have been determined not to exceed the actual cost of providing services.

Public Resource Code §21080(b)(8) states CEQA is not applicable to “The establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges by public agencies which the public agency finds are for the purpose of (A) meeting operating expenses, including employee wage rates and fringe benefits…” Other activities not applicable to LAFCO are also listed. A finding has been included in the resolution that the fees are to meet operating expenses.
