Pursuant to Public Resources Code section 21050.28, the project is exempt because it is the transfer and acquisition of an interest in land by a public agency for the preservation of natural conditions existing at the time of transfer, including plant and animal habitats; and preserves open space. Alternatively, pursuant to California Code of Regulations section 15317, the District's acceptance of the fee interest is exempt because it will maintain the open space character of the area.
