Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Sections 15262, 15378, and 15061(b)(3)
Reasons for Exemption
(a) The temporary cap on new vacation rental permits is intended to provide additional time to conduct public outreach, feasibility, and planning studies necessary for future actions by the Board of Supervisors and is statutorily exempt from environmental review under Section 15262 (a) Under CEQA Guidelines Section 15378, the temporary extension of a cap on vacation rentals is not a project under CEQA because it will not cause a "direct physical change in the environment," or a "reasonably foreseeable indirect physical change in the environment" because the ordinance is limiting in nature and do not authorize any specific development activity or promote new construction or growth. (b) Under CEQA Guidelines Section 15061(b)(3), CEQA review is not required because there is no possibility that this Ordinance may have a significant effect upon the environment.
