Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2019-0741-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. Peter G. Hanelt. The project is limited to thirty-nine (39) encroachments (Table 1). Two (2) encroachments are for water diversion from springs, unnamed tributaries to Rancheria Creek. Water is diverted by gravity for domestic use and fire protection. Work for the water diversions will include use and maintenance of the water diversion infrastructure. One (1) encroachment is for maintenance of an existing on-stream pond. The pond is used for aesthetic purposes and wildlife habitat. Water is not diverted from the pond for consumptive use. One (1) encroachment is for removal of existing culverts, re-establishing the channel at this location, and seasonal installation of a bridge. The temporary bridge shall be removed prior to the end of each seasonal work period. The thirty-five (35) other proposed encroachments are to upgrade, maintain, or decommission existing stream crossings (including replacing undersized culverts and installing rocked fords). As appropriate, work for these encroachments will include excavation, removal, installation and/or construction of stream crossings, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion. This Agreement does not authorize driving through streams (e.g. rocked fords) when water is present.

The project to be completed is located within the Navarro River watershed, approximately 6 miles northwest of the town of Yorkville, County of Mendocino, State of California. The project is located in Sections 3 and 4, T12N, R13W, Mt. Diablo Base and Meridian; in the Ornbaun Valley U.S. Geological Survey 7.5-minute quadrangle.

Reasons for Exemption
The project includes repair, replacement or decommissioning of stream crossings, and remediation of impacts of unpermitted work in response to a Notice of Violation from the California Department of Fish and Wildlife. There would be no significant adverse impact on endangered, rare or threatened species or their habitat from the remediation work, as permitted, pursuant to section 15065. There are no known hazardous materials at or around the project site that may be disturbed or removed. The remediation project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
