- The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under Chapter 6.5 Division of the Health and Safety Code (H&SC), has determined pursuant to H&SC Section 25395.95 that an LUC is reasonably necessary to protect present and future human health or safety or the environment from the potential risk from residual contamination at the Property. The LUC/deed restriction will prohibit the use of the property as a residence, hospital, school, daycare center, and will limit the property use to commercial/industrial purposes.

- DTSC has determined with certainty that there is no possibility that the activities in question may have a significant effect on the environment because the project would not result in "a substantial, or potentially substantial, adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise, and objects of historic or aesthetic significance.: There are also no greenhouse gas emission impacts since the proposed project will only implement signage and institutional controls.
