Document Description
SGPWA has a contract with DWR to bring supplemental water to the SGPWA service area. However, there is a need to meet future increasing demands for SGPWA supplemental water within SGPWA's existing service area. This will require additional water distribution and storage facilities and the acquisition of additional water rights.
Resolution No. 2015-05 imposes a facility capacity fee consistent with and authorized by Sections 101 - 27, 1(a) and (c) of the SGPWA Act. The facility capacity feet, which is in the nature of a connection fee, is imposed on new retail connections to the water distribution system of any retail water distributor that is located within the boundaries of the SGPWA and that obtains all or any portion of its water supplies from SGPWA.
The facility capacity fee will assist SGPWA to fund (1) the purchase of capacity in existing pipeline systems owned by other public agencies; (2) an additional basin recharge project for underground water storage in the Beaumont groundwater basin, including land purchases associated with such basin activity; and (3) the purchase of new water and/or water rights and entitlements to meet future water demand and maintain service within the existing SGPWA service area.

Approval of Resolution No. 2015-05, Resolution of the Board of Directors of the San Gorgonio Pass Water Agency to Adopt Facility Capacity Fees for Facilities and Water, is not subject to CEQA 21000 or 14 CCR 15000 et seq) because Resolution 2015-05 is not a "project" as the term is defined by the CEQA Guidelines. Specifically, SGPWA's adoption of the Resolution is not a project under State CEQA Guidelines section 15378(b)(4) because the Resolution involves the creation of a government funding mechanism or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.
While general needs have been identified, consistent with the SGPWA Act, and including purchase of new water rights and entitlements, the details or specifications on the exact scope of projects to be undertaken with the fees collected have not been determined. This adoption of Resolution 2015-05 is not a project as defined by CEQA and the State CEQA Guidelines and the Resolution is exempt from further CEQA review.
