Reasons for Exemption
Class 1 exempts the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment. The exemption further allows the "addition of safety or health protection devices for use during construction or in conjunction with existing structures..." The proposed project, the paving of approximately 23,000 square feet of existing turf area would enhance safety at the school site. The new paving would improve access for fire safety, and would be large enough for a fire truck to go behind the existing portable classrooms and turn around. The paving would be located at the northern side of the school site, north of the existing portable classrooms. A portion of turf will be retained between the paving and the City's adjacent park. There is no reasonable probability that the project will have a significant effect on the environment due to unusual circumstances because the site is already developed with an elementary school. Additionally, the site will be paved in such a way as to direct surface water runoff into the adjacent turf areas on the school site, and not into the City of Mission Viejo's storm drain system. Therefore, while the amount of impervious surface on the school site will be increased by approximately 23,000 square feet, the amount of water runoff from the site that enters the City storm drain wil not be increased.
